NEGLECT,INJURY AND FRAUD IN HOME CARE

Home health care is one of the fastest growing industries today.  Because of the Baby Boomers, this industry is anticipated to continue to grow at a rapid rate.  Surprisingly, there is no general regualtion of this industry.  Anyone who desires can obtain a business license and set up shop.  Unfortunately, most people contact a home health agency in a time of crisis.  They are reacting quickly to a medical emergency and signing on with the first company that presents itself, not having the opportunity to truly research who will be coming into their home.

When looking to hire an agency, we recommend you look for one that is "State Licensed".  An agency that is State Licensed must follow strict state mandated guidelines for quality of care.  Caregivers are classified by type of edcuation and experience, and must be qualified to care for a client and his / or specific medical condition.  Licensed nurses are required to oversee all client cases and supervise all caregivers. These agencies work under the understanding that at any time, the State can and will inspect for quality of care.

Caregivers employed by State Licensed Home Health agencies are carefully screened before being hired.  They are required to obtain fingerprints that are checked by the State of California and FBI for all criminal activity in and out of the State.  All references are checked, all certificates, all C.N.A., HHA, LVN and RN licenses are validated.  All employees are required to have physician physicals and are TB tested.  Potential employees must complete written exams and are closely monitored to ensure they can work under pressure.  All employees are required to continue their education with inservices, on the job training and ongoing schooling.  All employees are legal to work in the United States.

Some clients complain about the costs of State Licensed agency employees.  The costs allows the agency to pay for employment taxes and workers compensation insurance, also liability insurance is covered for all staff of the agency.  Are you aware that if you hire someone to work directly for you that you are legally responsible to pay for payroll taxes and workers compensation insurance?  You may also be running the risk that the caregiver may not be properly trained to care for your loved one.

There are some good home care companies that are not State Licensed.  You should make certain that you get a reliable reference from discharge planners, case managers or others in the community that are in the know.  Medicare agencies that are doing visits are also a good reference from home care companies thate pride themselves with qualified caregivers.

With the growth of home care, combined with poor regulation and an increase in the elderly population, each and every person that allows a stranger to come into their home runs the risk of theft, fraud and abuse.  Find the right caregiver and find the right agency to make certain your loved one is cared for with respect, tenderness and a positive experience that will enhance your loved ones life.
